1. General Terms and Acceptance

1.1. Introduction to Dihamarts: Dihamarts is an online store operated under the management of DHD, LLC (hereinafter referred to as "We" or "Dihamarts"). We specialize in providing Print-on-Demand (POD) products, mainly T-shirts, to the United States market.

1.2. Acceptance of Terms: These Terms of Service apply to all users of the site, including without limitation users who are browsers, customers who shop, vendors, or contributors of content. Use of our services signifies your acceptance and agreement to comply with all terms, policies, and notices posted herein.

1.3. Eligibility: You must be of legal age of majority in your state or province of residence to use this site, or have the consent of your parent/legal guardian. You agree that you will not use our products for any illegal or unauthorized purpose.

1.4. Changes to Terms: We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of the website after the posting of any changes constitutes acceptance of those changes.

2. Product and Service Terms (POD Model)

2.1. Nature of Products (POD): All products sold by Dihamarts are Print-on-Demand (POD) products. This means that each product is only printed, manufactured, and finished after your order has been successfully placed and paid for.

2.2. Availability and Color: We strive to display the colors and images of our products on the website as accurately as possible. However, we cannot guarantee that your computer monitor or mobile device screen will display the actual colors of the product accurately. The availability of base materials (e.g., T-shirt type, ink color) may change unexpectedly.

2.3. Limitations on Quantity: We reserve the right to limit the quantities of any products or services that we offer to any person, geographic region, or jurisdiction.

2.4. Product Disclaimer: We warrant that the products will meet quality standards upon delivery. However, we are not responsible for damage or defects arising from the customer's improper use, storage, or washing.

3. Payment and Billing Process

3.1. Pricing: The prices of products are listed in USD and include all applicable Sales Tax as required by United States law.

3.2. Pricing Errors: In the event of a pricing error on the website, we reserve the right to refuse or cancel any orders placed with the incorrect price, regardless of whether the order has been confirmed or paid for. If the order has been paid for, we will issue a refund according to the refund policy.

3.3. Payment Security: Payment processing is handled through the PayPal payment gateway. You agree to provide current, complete, and accurate purchase and account information for all purchases made on our site.

4. Delivery, Shipping, and Processing Time

4.1. Time Structure: Total delivery time consists of Processing Time of 3–5 business days (production, QC, packaging) and Transit Time of 7–10 business days.

4.2. Risk of Loss: The risk of loss and title for items purchased from Dihamarts pass to you upon our delivery to the carrier.

4.3. Accurate Address: You are solely responsible for providing an accurate and complete shipping address. We are not responsible for and will not issue refunds for orders that are lost or returned due to an inaccurate, incomplete, or undeliverable address caused by your error. You will be responsible for a reshipment fee if you wish to receive the product again.

5. Order Cancellation, Returns, and Refunds

5.1. Cancellation Policy: Orders can be canceled within 6 hours of successful payment, as the POD production process begins shortly thereafter.

5.2. Return Conditions: Returned products must be unworn, unwashed, and in their original condition. We reserve the right to refuse a refund if the product is deemed to have been used.

5.3. Refund due to Customer Error (Change of Mind): If you return a product due to a change of mind, you will bear the return shipping cost and will only receive a refund for the Product Value (excluding the original shipping fee).

5.4. Refund due to Dihamarts' Error: In the event of a product defect attributable to Dihamarts (faint print, stains, incorrect size/color compared to the order), we will refund the full total value of the order (including the original shipping fee) and cover the return shipping cost.

6. Third-Party Links

6.1. Third-Party Websites and Services: Third-party links to this site may direct you to websites not affiliated with us. We are not responsible for examining or evaluating the content or accuracy of any third-party websites or services.

6.2. Risk of Use: Your use of any third-party tools or services offered through the site is entirely at your own risk and discretion. Any claims, concerns, or questions regarding third-party products should be directed straight to the third-party.

7. Personal Information and Security

7.1. Information Collection: Your submission of personal information through the store is governed by our Privacy Policy. We commit to using this information solely for the purpose of order processing, shipping, and support contact.

7.2. Data Security: We apply SSL/TLS security standards to protect transmitted data. We do not store your credit/debit card details.

8. Intellectual Property Rights and User Content

8.1. Dihamarts' Ownership: All content on the site (including design, logos, text, graphics, and interface) is the exclusive property of DHD, LLC and is protected by U.S. and international intellectual property laws.

8.2. Prohibited Use: You may not reproduce, duplicate, copy, sell, or exploit any portion of the Service or products without express written permission from us.

8.3. User-Provided Content: If you submit ideas, suggestions, or other content (e.g., product reviews) to us, you agree that we may, at any time, edit, copy, publish, distribute, and use those contents in any medium without compensation to you.

You are prohibited from using the site or its content for any of the following purposes:

10. Disclaimer of Warranties and Limitation of Liability

Limitation of Liability: To the maximum extent permitted by law, in no case shall DHD, LLC, our directors, employees, affiliates, agents, contractors, suppliers, and service providers be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost data, or similar damages, whether based in contract, tort (including negligence), strict liability or otherwise.

You agree to indemnify, defend and hold harmless DHD, LLC and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

12. Severability and Termination

12.1. Severability: In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service.

12.2. Termination by Our Initiative: The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. We may terminate this agreement at any time without notice if we believe that you have violated any term of these Terms of Service.

13. Entire Agreement and Governing Law

13.1. Entire Agreement: Our failure to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. These Terms of Service constitute the entire agreement and understanding between you and us.

13.2. Governing Law: These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Colorado, United States, applicable to agreements made and to be entirely performed within Colorado.
